Commission Only Real Estate Salesperson Employment Contract (NSW)
An employment contract for a real estate salesperson paid on commission only, built around the Real Estate Industry Award.
Before you start
- Check the employee is eligible: commission-only employment is only lawful if the employee meets every eligibility condition in clause 4 before the contract is signed. If the employee does not meet all of them, you cannot use this contract and must use a wages plus commission contract instead.
- Check the current Award: Award rates and the minimum income threshold amount (MITA) change each 1 July. Check the current Real Estate Industry Award 2020 on the Fair Work Commission website before each use.
- NSW only: this contract is drafted for an employee working in New South Wales. If the employee works in another State or Territory, the licensing, long service leave, workplace surveillance and governing law terms need to change, so get legal advice.
