1. About this policy
Legally Sorted (legallysorted.com.au) is an online legal documents service operated by Corporate Legal Pty Ltd (ABN 52 640 661 847), an incorporated legal practice in New South Wales trading as Legally Sorted (we, us, our). Our principal and responsible solicitor is Zohra Ali.
This policy explains how we collect, hold, use and disclose personal information, and how you can access it, correct it or make a complaint. We comply with the Australian Privacy Principles in the Privacy Act 1988 (Cth) when we handle personal information.
As a legal practice, we also owe duties of confidentiality to our clients under the Legal Profession Uniform Law (NSW) and the conduct rules. Those duties apply in addition to this policy.
2. The information we collect
The information we collect depends on the document you choose and the answers you give. It usually includes:
• Your contact details: your name, email address, phone number and business name. For solicitor-checked orders we also collect your address, which appears on your costs disclosure.
• Details of other people: names, addresses, email addresses and phone numbers of other people involved in your matter, such as counterparties, employees, beneficiaries, guarantors and directors.
• Business details: ABNs, ACNs and other details about businesses and companies.
• Financial details: prices, amounts and other financial and business details relevant to your document.
• Family details: for wills and trusts, details of your family members, including children.
• Uploaded documents: documents you choose to upload, such as specifications, trust deeds and judgments, and any personal information in them.
• Order details: what you ordered, when, the amount paid and the documents we generated for you.
• Technical information: when you visit our website, our hosting provider processes technical information such as your IP address and browser type so the website can be delivered to you.
• Identity information: where the law requires it, including under the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth), we may ask for identification documents and details to verify your identity or the identity of a business, its owners or controllers.
We do not collect or store your card details. Card payments are entered directly into our payment provider's secure payment form.
3. Sensitive information
Some of what you tell us or upload may be sensitive information, such as health information or criminal record information contained in a judgment. We only collect sensitive information with your consent, which you give by entering or uploading it, and only where it is reasonably necessary for your document or our legal services. Please do not include sensitive information that your document does not need.
4. Information about other people
Many of our documents need details of other people. If you give us information about someone else, please make sure you are entitled to give it to us, and where practical let them know that you have given it to us and that this policy explains how we handle it.
5. How we collect information
We collect information:
• From you: through the questions on our website, the documents you upload, the details you give at checkout and when you contact us.
• From our service providers: for example, our payment provider confirms to us whether your payment was successful.
• From others where needed: for solicitor-checked orders, a solicitor may need further information about your matter, and will usually ask you for it.
You can browse our website without telling us who you are. To prepare a legal document for you and take payment we need to know who you are, so we cannot provide documents anonymously or under a pseudonym.
6. How we hold and protect information
• Draft answers before checkout: while you answer our questions, your draft answers are saved only in your own web browser (local storage) on your device. They are not sent to us until checkout, and no account is needed. You can delete them by clearing your browser's site data for our website.
• Orders and documents: when you check out, your order is created. Your order, answers, uploaded files and generated documents are stored with our database and file storage provider, in Australia.
• Private files: uploaded files and generated documents are kept private and can only be reached through links that expire after a limited time.
• Website and document generator: our website and document generator are run by our hosting provider. The parts that process your order run in Australia.
• Payments: card details go straight to our payment provider. We never see or store them.
We take reasonable steps to protect personal information from misuse, interference, loss and unauthorised access, change or disclosure. If a data breach is likely to result in serious harm to you, we will notify you and the Office of the Australian Information Commissioner as the law requires.
7. Why we collect, use and disclose information
We collect, use and disclose personal information to:
• Prepare your document: to generate your document from your answers.
• Provide legal services: for solicitor-checked orders, so a solicitor can review your document and act for you.
• Take payment: to process your payment and issue your tax invoice.
• Communicate with you: to send you order confirmations, your documents and other messages about your order.
• Meet our legal obligations: including legal practice record keeping under the Legal Profession Uniform Law (NSW) and the conduct rules, our obligations under anti-money laundering and counter-terrorism financing laws, and tax and record keeping laws.
We do not sell personal information, and we do not share it with others for their marketing. We do not use your answers or documents to train AI models. We do not currently use your information to send you marketing. If we do in future, we will give you an easy way to opt out.
We may also use or disclose personal information where the law requires or allows it, or where you have agreed.
8. Decisions made by computer programs
Our documents are generated by software. The software works from rules and templates that we have prepared, and it makes or helps make decisions that can affect your legal rights and access to our services.
What information the software uses
The software uses your answers to our questions. Depending on the document, this includes the names and contact details of you and other parties, their roles in the matter, ABNs and ACNs, prices, financial and business details, and for wills and trusts, details of family members and children.
Decisions the software makes on its own
• Document content: the software decides which clauses and wording go into your document, based on your answers.
• Routing to a solicitor: the software decides whether your request can proceed as an online document or must be sent to a solicitor for a quote, for example because your matter is outside what the template covers. This decision affects whether you can buy the document online.
• Solicitor check required: the software decides whether your document must be solicitor-checked rather than DIY.
DIY documents are generated by the software and are not reviewed by a person.
Decisions the software helps a solicitor make
For solicitor-checked orders, the software prepares the draft document and a solicitor then reviews it. The solicitor decides the final form of the document.
Questions about an automated decision
If you think the software has routed your request incorrectly, or you want to know more about how a decision was made, contact us and a solicitor will look at it.
9. Who we share information with
We share personal information only as needed for the purposes in section 7. This includes:
• Technology service providers: providers who host our website and document generator, store our database and files, deliver our emails and support the software we use to prepare and review documents.
• Our payment provider: processes card payments.
• Professional advisers: such as our insurers, auditors and accountants, where needed.
• AUSTRAC: where we are required to report under anti-money laundering and counter-terrorism financing laws.
• Others where required: regulators, courts and other bodies where the law requires it, or other people where you ask us to.
10. Overseas disclosure
Our main database and files are stored in Australia. However, some of our service providers are based overseas, or may process or access information outside Australia, for example to deliver website requests, process payments, send emails or provide technical support.
The country where these overseas recipients are most likely to be located is the United States. Some providers may also process information in other countries where they operate their systems. We choose providers that we consider to have appropriate privacy and security practices.
11. Cookies, analytics and local storage
We do not use analytics or marketing tracking on our website. Our website uses your browser's local storage to save your draft answers before checkout, as explained in section 6. Our service providers, such as our payment provider on the payment form, may use their own cookies or similar technology to operate their services and prevent fraud.
If we add analytics or other tracking in future, we will update this policy before we do.
12. How long we keep information
We keep order and matter records, including your answers, uploads and documents, for at least 7 years. This applies to DIY and solicitor-checked orders and to quote requests, consistent with our record keeping obligations as a legal practice and under anti-money laundering laws. When we no longer need personal information and the law does not require us to keep it, we take reasonable steps to destroy it or de-identify it.
13. Accessing and correcting your information
You can ask for access to the personal information we hold about you, or ask us to correct it, using the contact form on our website or the details in section 16. We may need to confirm your identity first.
We will respond within 30 days. We do not charge you for making a request. In some cases the law allows us to refuse access, for example where giving access would affect another person's privacy or where the information is subject to legal professional privilege. If we refuse, we will tell you why in writing and how to complain.
14. Complaints
If you think we have breached the Australian Privacy Principles or mishandled your personal information, please contact us first:
• Online: the contact form on our website
• Post: Legally Sorted, Suite 19, 103 George Street, Parramatta NSW 2150
• Phone: 02 7813 4754
