Deed of Appointment and Removal of Trustee (NSW)
Change the trustee of a trust: remove a trustee, appoint a new one, or both.
Before you start
- The will or trust deed: Have a copy of the will (and the grant of probate) or the trust deed, including every deed that has amended it. You will need the clause number that gives the power to appoint and remove trustees.
- Check who holds the power: Read the will or trust deed to confirm who holds the power to appoint and remove trustees, and that it has not been released or passed to someone else.
- Check how the power must be used: Confirm whether the power must be exercised by deed or by written notice, whether anyone else must consent, whether there is a minimum number of trustees, and whether any person (for example the person who set up the trust, or a foreign person) is not allowed to be a trustee. If the power is not used exactly as the will or trust deed requires, the change of trustee may not be valid.
- Party details: Full names and addresses of the Appointor, every current trustee, each retiring trustee and each new trustee. For a company, its full name, ACN and registered office.
