Deed of Rectification of SMSF Bare Trust Deed (NSW)
Correct a genuine mistake in a bare trust (custodian) deed for an SMSF borrowing arrangement.
Before you start
- Check the deed is right for you: Only use this deed to fix a recording mistake. It cannot be used to change who actually owns the property. If you now want a different beneficiary, or the property was not paid for with SMSF money and the SMSF loan, this deed is not suitable. Contact us for a quote instead.
- The original bare trust deed: Have a copy, and note every place where the wrong name appears (the parties section and the relevant clauses).
- Property and title: The property address and folio identifier, and a recent title search showing who is the registered owner.
- Loan documents: The loan agreement and mortgage, the lender's name, the loan date and the loan reference number.
