Employment
Employment Agreement (Full-time or Part-time, NSW)
A full-time or part-time employment contract for NSW employees, written to sit alongside the Fair Work Act and modern awards.
Before you start
- Who this agreement suits: a permanent full-time or part-time employee of a business that is covered by the national workplace relations system. Most companies, and trusts with a company trustee, are covered.
- Who it does not suit: casual employees, commission-only employees, apprentices or trainees, and employees covered by an enterprise agreement. Casual employees need a casual employment agreement.
- Genuine employment only: whether a person is an employee or a contractor depends on the real substance and practical reality of the whole working relationship, not just what the contract says. Only use this agreement where the person is genuinely an employee.
- Check the Award first: find the modern award (if any) that covers the role and check the current minimum pay rates before you set the salary. Underpaying wages or superannuation on purpose is now a criminal offence.
What you'll need
Your business name, ACN, ABN and address; the employee's full name and address; the job title, manager, start date and work location; any licence or clearance the role needs (such as a working with children check); the Award and classification; the salary and pay frequency; the hours and days of work; your default superannuation fund and its USI; and any notice period longer than the legal minimum.
