Mirror Wills for Couples (NSW)

Matching wills for a married or de facto couple in NSW, each leaving everything to the other and then to the children.

Before you start

  • Who these wills suit: couples who are married or in a de facto relationship (of any gender) whose children are all children of both of them, and who want to leave everything to each other and then to those children.
  • Mirror wills are not mutual wills: each of you can change your will at any time, including after the other has died. The surviving partner can then leave the combined estate to anyone. If you want a binding promise that neither of you will change your will, you need legal advice about a mutual wills agreement.
  • Assets that do not pass under your will: property you own with your partner as joint tenants passes automatically to the survivor, whatever your will says. Superannuation is not part of your estate unless it is paid to your estate under a binding death benefit nomination or the rules of your fund. Check your super nominations so they match what you want.

What you'll need

Each partner's full name, address and occupation; the full names of all of your children; the names and addresses of 1 or 2 backup executors and a second backup executor; the names and addresses of a guardian and a backup guardian for children under 18; who should receive your estate if your partner, children and grandchildren all do not survive you, and in what shares; and the age at which your children should receive their share (any age from 18 to 25).
