Short Form Services Agreement (Independent Contractor)

Engage an independent contractor for a defined piece of work, with scope, fees, insurance and IP covered.

Before you start

  • Genuine contractors only: this agreement is for a genuine independent contractor doing a defined piece of work. It is not suitable where the consultant will work like an employee, for example with set hours, ongoing work under your control, payment for time rather than results, or using your equipment. Whether a person is an employee or a contractor depends on the real substance and practical reality of the whole relationship, not just the label in the contract.
  • Superannuation: if the consultant is an individual paid wholly or mainly for their labour, you may have to pay superannuation for them even though they are a contractor. Check with your accountant.
  • Not for building work: if the services are construction work, or goods and services related to construction work, in NSW, the security of payment laws apply and cannot be excluded. Use a construction contract instead.

What you'll need
